Terms of Service

Arrive Hospitality LLC (“Arrive”) operates a platform that allows consumers to create a portable profile so that service businesses and other consumers they authorize can recognize and personalize their experience. Arrive is not a medical, legal, financial, or other licensed professional service, and does not store protected health information, legal case information, or financial account data.

You must be at least 18 years old to create an Arrive account.

You are responsible for the accuracy of information in your profile and for maintaining the security of your account credentials. You agree to notify us promptly of any unauthorized use of your account.

Arrive’s communications with you are governed by the consent mechanisms described in our Privacy Policy. By checking the SMS consent box presented during onboarding, you agree to receive text messages as described there. You may withdraw that consent at any time by replying STOP to any message. Consent to SMS communication is never required to use the core, non-SMS features of the Arrive platform.

You agree not to:

• Provide false information in your profile or impersonate another person or business;
• Use Arrive to harass, stalk, or threaten another person;
• Attempt to access another user's account or another business's data without authorization;
• Write private notes about another user that are unlawful, harassing, or abusive;
• Use Arrive for any unlawful purpose.

Businesses using Arrive’s platform additionally agree to:

• Use consumer profile data solely to provide personalized service to that specific consumer, and for no other purpose;
• Never attempt to access, or assist any third party in accessing, another business’s consumer data;
• Not upload, request, or store medical, clinical, legal case, or financial account information in any Arrive field;
• Comply with all applicable consumer protection, privacy, and telecommunications laws, including but not limited to the Telephone Consumer Protection Act (TCPA) and CAN-SPAM Act;
• SMS and Email Consent Warranty. Where Business provides Arrive with a consumer’s contact information for the purpose of an Arrive invitation, Business represents and warrants that it has a lawful basis and existing relationship with that consumer (such as a reservation, appointment, or account relationship) sufficient to justify Arrive’s outreach via email, and acknowledges that any SMS consent is collected directly by Arrive via the email opt-in flow described in Arrive’s Privacy Policy, not assumed from the Business relationship alone;
• Indemnify and hold harmless Arrive from any claim, fine, or penalty arising from Business’s breach of this Section 6.

Arrive and its logo, design, and platform are the property of Arrive Hospitality LLC. You retain ownership of the content you submit (such as your profile photo and preferences), but grant Arrive a limited license to display that content to the businesses and individuals you authorize.

ARRIVE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DO NOT GUARANTEE THAT PERSONALIZATION OR RECOGNITION FEATURES WILL FUNCTION WITHOUT ERROR OR INTERRUPTION AT ALL TIMES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ARRIVE HOSPITALITY LLC’S AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF ARRIVE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO ARRIVE IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100). ARRIVE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES OF ANY KIND.

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law provisions. Any dispute arising from or related to these Terms or your use of Arrive that cannot be resolved informally will be resolved by binding arbitration conducted in Tarrant County, Texas, under the rules of the American Arbitration Association.

You may delete your account at any time through the app. We may suspend or terminate accounts that violate these Terms, with or without notice, depending on the severity of the violation.

We may modify these Terms from time to time. Continued use of Arrive after changes take effect constitutes acceptance of the revised Terms. Material changes will be communicated in advance via email or in-app notice.
